Two separate actions in the Hennepin County District Court by Twin City Candy and Tobacco Company, Inc., and Minnesota Candy & Tobacco Distributors Association to enjoin defendant from selling cigarettes below the legal cost in violation of the Unfair Cigarette Sales Act. In the first action, the court, Stanley D. Kane, Judge, granted defendant's motion for summary judgment and plaintiff appealed from the judgment entered; in the other, the court, William D.
